Terms Of Service
Scope
These Terms of Service set out the general framework for the services offered by MySpot Buyers, a specialist buyer-representation division of MySpot Barcelona, S.L.
The specific scope, fees, duration, search area and any exclusivity arrangements will be set out in the individual service agreement signed with each client. If there is any conflict, the individual agreement will take precedence.
Formation of the client relationship
Submitting an enquiry, requesting information, downloading a guide or booking an introductory call does not create a contractual relationship.
Services begin only once the relevant service agreement has been accepted or signed and any agreed initial payment has been made.
Services
Depending on the agreed package, MySpot Buyers may provide:
- property-search strategy and definition of requirements;
- market screening, pre-visits and shortlisting;
- price analysis and negotiation support;
- coordination of legal, documentary, technical and financial checks;
- coordination with lawyers, architects, mortgage specialists, notaries and other professionals;
- assistance through the offer, reservation, arras, completion and agreed post-purchase stages.
The exact services included will be confirmed in writing before the engagement begins.
Professional limitations
Unless expressly agreed otherwise, MySpot Buyers does not itself provide legal, tax, architectural, engineering, mortgage or financial advice.
These services must be provided by the corresponding qualified independent professional.
MySpot Buyers cannot guarantee that a particular property will remain available, that an offer will be accepted, that financing will be approved or that a transaction will complete within a specific timeframe.
Client responsibilities
The client agrees to provide accurate and complete information, respond within reasonable timeframes and disclose any circumstances that may affect the search, financing or purchase.
The client must also provide any documents, proof of funds or financing information reasonably required for the agreed service.
The final decision to proceed with any property remains the client’s responsibility.
Property information and third parties
Property information may initially come from owners, sellers, listing agents, public records or other third parties.
MySpot Buyers will carry out or coordinate the checks included in the agreed service, but a property should not be treated as fully verified until the relevant legal, documentary, technical and financial reviews have been completed.
Any lawyers, architects, technical inspectors, mortgage advisers, notaries or other professionals introduced or coordinated by MySpot Buyers act independently and are responsible for their own advice, reports, fees and services.
Fees and termination
Fees, taxes, payment dates, third-party expenses, duration, exclusivity and termination conditions will be stated in the individual service agreement.
Termination does not affect fees already due, work already completed or properly incurred third-party expenses.
Where a consumer enters into an agreement at a distance, any applicable statutory withdrawal rights will be explained before the service begins.
Liability
MySpot Buyers will perform the agreed services with reasonable professional care.
It is not responsible for inaccurate information supplied by the client or third parties, decisions taken contrary to professional recommendations, or delays and decisions caused by sellers, banks, registries, notaries, public authorities or independent professionals.
Nothing in these Terms excludes liability that cannot legally be excluded or limits mandatory consumer rights.
Personal data and confidentiality
Personal data will be processed in accordance with the Privacy Policy.
Confidential information may be shared with relevant professionals or service providers only where necessary to perform the agreed service and in accordance with applicable data-protection requirements.

These Terms are governed by Spanish law. Any dispute will be submitted to the courts with jurisdiction under the applicable legislation, without affecting any mandatory rights available to consumers and users.
